Version 20 August 2026
Terms and conditions
The agreement between you and Union AI. We have tried to write it the way we would explain it: the points that can work out against you are stated explicitly, not buried.
Draft
1. The service: models and inference
Union AI provides access to open-weight language models through an OpenAI-compatible API and a chat interface. Inference is carried out on infrastructure inside the European Union. We do not train a base model of our own; which models we use is set out on AI transparency.
2. The chat plan and fair use
The chat is sold as a monthly subscription of €13 excluding VAT, which includes access to every tier on the pricing page. Optional add-ons are charged per month on top and can be switched off individually. Payment is taken at the start of each month and renews until you cancel.
The plan carries a fair-use ceiling of 2,000 messages per calendar month; a message on the Pro tier counts as 5. Above that ceiling the chat continues out of prepaid credit at the rates in section 3, or pauses until the next month if you have no credit and have not asked us to use it. We never invoice for the excess afterwards.
You can cancel at any time from your account, without notice and without contacting us. The plan then runs to the end of the month you have paid for and is not renewed. We do not refund a part-used month, except where mandatory consumer law says otherwise.
3. Prepaid credit, payment and VAT
The API is prepaid. You buy credit in euros and each request lowers your balance by the price of the tokens used, at the rates on the pricing page. If your balance is insufficient, the request is refused with a 402. You are never invoiced in arrears and your balance cannot go below zero.
The minimum top-up is €10. Credit is valid for 24 months from the date of purchase; after that it expires. If you switch on automatic top-up, a daily limit that you set always applies.
All prices exclude VAT. Business customers within the EU with a valid VAT number get the reverse charge. We may change rates with 30 days' notice; credit already bought keeps its value in euros, but the amount of tokens you get for it can therefore change.
4. Availability, degradation and outages
Read this if you are building something critical
If a model is unreachable, we may run your request once on an alternative model within the same tier. If that alternative is weaker or has a smaller context window, we mark the response with X-EU-Degraded: true and charge the lower of the two rates.
If a model refuses a legitimate question about politics, history or a socially sensitive subject, we may run the request once on a different model. We expressly do not do this for refusals on safety grounds.
5. Your use and your API keys
You do not use the service to obtain instructions for weapons, malware or fraud, nor for material that harms children, nor for anything that is prohibited under Dutch or European law. You are responsible for what you do with the output: language models produce incorrect answers with conviction.
You keep your API keys safe. Usage through your key is at your expense. So set daily and monthly caps per key: that is the only hard limit on what a leak can cost you. If you suspect abuse, revoke the key immediately and report it to hello@europeanailab.eu.
If usage spikes to more than ten times your weekly average within an hour, we pause the key concerned automatically and inform you. That is meant to protect you, and it can interrupt a legitimate spike.
6. Right of withdrawal for consumers
If you buy credit or a chat plan as a consumer, you have in principle fourteen days to reconsider. Because the service is available immediately, at checkout we expressly ask you to agree to immediate performance and thereby waive your right of withdrawal for the part you have already used. That consent is a separate choice, not pre-ticked, and we record it.
If you do not give that consent, you can withdraw within fourteen days. Unused credit is then returned to you.
7. Refunds and termination
You can end your account at any time; there is no notice period and no minimum purchase. Ending a chat plan is covered by section 2. Business customers can request a refund of unused credit, less transaction costs. Expired credit is not refunded.
We may suspend an account in the event of abuse, on suspicion of fraud or when a payment is charged back. If we suspend an account through no fault of yours, you get your remaining credit back.
8. Liability and its limits
Our liability is limited to the amount you paid us in the three months preceding the event that caused the loss. We are not liable for consequential loss, lost profit or loss caused by unavailability of the service. These limitations do not apply in the event of intent or wilful recklessness on our part, and not in so far as mandatory consumer law provides otherwise.
9. Changes and governing law
We announce changes to these terms 30 days in advance by email. If you do not agree with them, you can end your account and request a refund of unused credit. Dutch law applies to this agreement.
Frequently asked questions
How long is prepaid AI credit valid?
Credit is valid for 24 months from the day you buy it, after which it expires. The minimum top-up is €10, there is no monthly minimum spend, and your balance can never go below zero.
Can I get a refund on unused credit?
Business customers can request a refund of unused credit, less transaction costs. Expired credit is not refunded. If we suspend an account through no fault of yours, you get the remaining credit back.
Can prices change after I have bought credit?
Rates can change with 30 days' notice by email. Credit you already bought keeps its value in euros, so nothing is taken away, but the number of tokens that euro buys can move. If you do not accept a change, you can close the account and ask for unused credit back.
Do consumers have a right of withdrawal?
Yes, fourteen days in principle. Because the service is available immediately, checkout asks you to agree to immediate performance and thereby waive the right for the part you have already used. That consent is a separate, unticked choice, and without it you can still withdraw within fourteen days and get unused credit back.
Which law applies to the agreement?
Dutch law. Mandatory consumer protection in your own country of residence continues to apply on top of that, and nothing in the terms is meant to reduce it.
